A Homeowners Association (HOA) is a non-profit organization in a planned community. An HOA is created by the developer with the purpose of ensuring the community continues to be well maintained and if possible enhanced over time. The association is turned over to the community to manage, this occurred in 2010 for the West Rutherford Homeowners Association (WRHOA).
In essence the HOA works collectively for the community.The HOA collects dues from each lot owner, a specified fee which is predetermined by the HOA and reviewed annually.These resources are used exclusively for the maintenance and enhancement of the community of West Rutherford ensuring that it remains a vibrant and attractive place to live.

No. Membership is mandatory and automatic for all property owners within the WRHOA boundaries. The monies acquired through the low annual fees allow the community to have the available resources to maintain the highest quality condition of the neighborhood. These revenues can also be used for much needed, and sought after, enhancements to the community such as park benches or a skating rink.
HOA fees are due annually.Outstanding fees will be directed for collections with all costs incurred to be the responsibility of the homeowner.Any outstanding fees must be rectified prior to any property sale as there is a registered encumbrance on each land title.
The Board of Directors is responsible for setting the annual fees as part of the budget process. This exercise takes place at each fiscal year end. The WHROA fiscal year runs from December 1 until November 30 therefore dues for the calendar year are due prior to December 1. The current rates have been in place since 2010 and are as follows:
- Single family homes (detached, duplex, triplex and fourplex) annual fee is $150.00.
- Multi-family homes (condominium, apartment, townhouse) annual fee is $75.00.
All HOA members who choose to submit their fees prior to August 31 are offered an early incentive amount, reducing the annual fees to $100.00 for single family homes and $50.00 for multi-family units. There is no GST on the HOA fees
Payments received on or after November 30 will be subject to late fees. All outstanding files will be sent to collections and associated costs incurred will be the responsibility of the home owner. Any outstanding fees must be rectified prior to any property sale as there is a registered encumbrance on each land title.

At present the WRHOA maintains the perimeter fence and the wood fence that borders onto the public walkways, the front entry markers and specified light standards along the trails. It is also responsible for maintaining the fountain in the two community ponds (but not the lake itself). As the City of Edmonton continues to have responsibility for the parks, playground and areas along the walkways the WHROA has established a close working relationship with the City so that areas of common concern can be addressed more efficiently and effectively.
In addition, the West Rutherford HOA is responsible for upholding the Association’s Articles (i.e. by-laws) and Architectural Guidelines, The association is governed by a Board of Directors, all of whom are neighborhood volunteers, elected by the membership at the Annual General Meetings.

Annually a list of priorities is determined and a budget allocated to cover these costs.A small amount of the budget covers the operational costs associated with a property management service and HOA administrative costs however the majority of the resources are directed to maintaining and improving our community.Any and all surplus dollars are placed into a secured reserve fund and held for future expenditures.

The architectural constraint is an encumbrance that is registered with land titles for each property within West Rutherford. This document describes some architectural guidelines that property owners must follow. Some examples of this are the type of fence, type of shingles on the roof, entrance and landscaping features.
To obtain the specifics on your property refer to the encumbrance that is registered on your land title certificate. If you do not have a copy of the encumbrance, you can obtain a copy from the Land Titles Office at (780) 422-7874 or by visiting Service Alberta – Find Titles, Documents or Plans page. You can find copies of the encumbrance on our website under the bylaws. If you are the original buyer of a property in West Rutherford, your Builder should also have provided you with written information on the Architectural Controls applicable to your particular property. The architectural constraints for West Rutherford Homeowners Association are intended to maintain the aesthetic look of the area within the Homeowners Association, however the West Rutherford Homeowners Association acknowledges that these architectural constraints may be altered or amended from time to time. If the architectural constraints are changed, the HOA will provide notice of such changes to the owners.
If the architectural constraints relating to roofing materials, colours or specifications are amended, any homes where the roofs were completed in accordance with the architectural constraints before they were amended will be deemed to comply with the new architectural constraints, however any roof changes that are made after notice of the amendments to the architectural constraints will be subject to the new amendments.
